Elite Kitchen & Bathroom Terms and Conditions
1. Sales Prices: All prices are valid for twenty-one (21) days from the quotation date. Prices do not include any applicable taxes, duties or delivery. Pricing displayed in the showroom may not be the most recent price. In the event where the price in the system differs from the display price, the system price will be applicable.
2. Deposits: All orders require a 50% deposit to be paid in order to confirm and process an order. All deposits will be held in its entirety until the last shipment of products. The balance of the purchase price is payable by the customer upon pick up or prior to final delivery. No products shall be released until the entirety of the order has been paid in full.
3. Order Receipt & Storage: Customers must pick up or accept delivery of all materials within seven (7) days of the requested finishing date. If the customer wishes to delay their final shipment, the customer may be charged at Elite Kitchen & Bathroom’s sole and absolute discretion. The customer shall be required to pay the full amount for goods ordered, including any charges incurred, whether the customer is ready to receive/accept their goods. Furthermore, in such an event, Elite Kitchen & Bathroom may, at its sole and absolute discretion, charge the customer a monthly storage fee of 3% of the total value of the order, plus taxes. However, Elite Kitchen & Bathroom shall in no way be obligated or required to store any material on the customers’ behalf. For greater certainty, Elite Kitchen & Bathroom may, at its sole and absolute discretion, dispose of any materials not accepted by the customer.
4. Pick-ups & Deliveries: Elite Kitchen & Bathroom agrees to work to meet the Customers’ finishing date. However, the customer acknowledges that this date may vary and may be out of Elite Kitchen & Bathroom’s control. Therefore, the customer acknowledges and agrees that Elite Kitchen & Bath shall not be liable for any and all delays in the procurement of goods. The customer also acknowledges that Elite Kitchen & Bathroom does not warrant and/or guarantee the final shipment date of material by the customer’s requested date. The customer further acknowledges and agrees that any and all transportation costs shall be paid out by the customer to Elite Kitchen & Bathroom in accordance with the payment terms agreed upon by the parties, and that any and all transportation of goods by a third party is at the customers’ sole and exclusive risk and expense, regardless of whether such third-party transportation was arranged by Elite Kitchen & Bathroom on the customers’ behalf. Elite Kitchen & Bathroom does not warrant and or/guarantee any third-party delivery or transport, including but not limited to any quality of service or delivery of material.
5. Delivery Terms & Conditions: Any and all deliveries are subject to a charge, which is to be determined based on the distance of the job site from the Elite Kitchen & Bathroom showroom address. Elite Kitchen & Bathroom reserves the right to apply additional delivery charges for out of zone deliveries. Elite Kitchen & Bathroom will deliver ONLY to the garage or front door in instances where the driveway is unobstructed and suitable for safe use, or curbside when driveway is not safe for use, and is at the sole and absolute discretion of Elite Kitchen & Bathroom’s delivery driver. Elite Kitchen & Bathroom will not be responsible for deliveries to any other parts of the customers’ household and/or business. The customer must ensure that driveways and delivery area is free of obstructions (i.e., snow, earth, construction debris, vehicles, etc.…). Failure to ensure delivery area is free of obstruction could result in a re-attempt at the expense of the customer. For apartment and condominium buildings delivery will be made to the loading dock/area ONLY. Customer must ensure that a responsible individual over the age of 18 is available to sign for the delivery. Customers must count, open an inspect all contents of the order before accepting delivery. Any damages, missing items or wrong items must be reported back to Elite Kitchen & Bathroom at the time of delivery or pickup, and no later than 48 hours after. Failure to report damages/missing/incorrect items within this period could result in potential incurred costs by the customer.
6. Warranty: Elite Kitchen & Bathroom is not responsible for any warranty or service issues. All products warranties are subject to terms and conditions of the manufacturer. Elite Kitchen & Bathroom will act in good faith to support the customer with warranty issues, but ultimately responsibility and resolution will be dependant on the manufacturer of the product. Elite Kitchen & Bathroom’s warranties varies in accordance with its various products and brands. Elite Kitchen & Bathroom’s warranty and liability shall in all cases be limited to the replacement parts or product, and will not extend to any transportation costs, labour costs or damages. At all times, customers and/or installers must inspect the product in question upon delivery and/or pickup and report any damages or missing parts/items at that time, or up to 48 hours after. Elite Kitchen & Bathroom will not be held liable for any claims of whatever nature once the product is installed or part the allowable time frame of reporting damages and missing parts/items. It is the responsibility of the customer to have the products installed by a qualified installer and according to the manufacturers’ instructions.
7. Returns & Exchange Policy: All merchandise returned must be in its original box and should not have been installed. Only unopened and/or full boxes will be accepted. No returns or exchanges will be accepted for customer orders pertaining to custom order items, vanities, promotional items, floor models or clearance items. Depending on the nature and brand of the product, a restocking fee of minimum 25% will be applied. Original copy of the invoice is necessary to process any returns or exchanges. Returns or exchanges must be approved by an Elite Kitchen & Bathroom sales representative or manager within a period of seven (7) days of purchase. Any refunds will be issued as a store credit.
